About Trademark Counsel India

India’s Private Platform for Trademark Facilitation & Lawyer Coordination

Private Platform Not a Government Body Administrative Facilitation Only
!
Important: TrademarkCounselIndia.org is a private administrative facilitation platform. We are NOT the Trade Marks Registry, NOT affiliated with any government authority, NOT a law firm, and do NOT provide legal advice or legal representation. Independent Lawyers connected through this Platform act in their own professional capacity.

TrademarkCounselIndia.org is a private administrative facilitation and case-management platform. We help individuals, businesses, startups, and MSMEs connect with independent, empanelled trademark Lawyers — making the process of understanding, initiating, and coordinating a trademark matter simpler and more accessible. We are not a law firm and we do not provide legal advice. We are a coordination and facilitation platform, and all legal work is carried out exclusively by independent Lawyers in their own professional capacity.

🏢 Who We Are

TrademarkCounselIndia.org is owned and operated by a private company. The Platform was built to address a common challenge faced by applicants — understanding how the trademark process works, identifying the right class, gathering the correct documents, and finding a qualified Lawyer to assist with filing — all in one place, without confusion.

We are an administrative facilitation platform, not a law firm and not a government service. Our team consists of administrative coordinators and case-management professionals, not lawyers, advocates, or legal advisers. We do not practice law, render legal opinions, or represent anyone before any authority.

Private Platform: TrademarkCounselIndia.org has no affiliation with the Trade Marks Registry, the Office of the Controller General of Patents, Designs & Trade Marks (CGPDTM), IP India, the Ministry of Commerce and Industry, or any Central or State Government authority.

What We Do

Upon the User’s explicit request and consent, the Platform facilitates administrative coordination between the User and an independent Lawyer empanelled on the Platform. Our role is strictly administrative and includes:

Step 01

Request Intake & Query Handling

We receive and process the User’s trademark service request, gather preliminary information through our online form, and handle initial queries for administrative clarity.

Step 02

Lawyer Availability Coordination

We identify and coordinate with an independently empanelled Lawyer who is available based on the User’s provided information and requirements, upon the User’s request.

Step 03

Document Organisation (Non-Legal)

We assist with formatting, arranging, and organising documents submitted by the User for the Lawyer’s review. We do not prepare or draft legal documents or trademark applications.

Step 04

Scheduling & Communication Support

We provide scheduling assistance, reminders, follow-up support, and communication channels to facilitate coordination between the User and the independent Lawyer.

Step 05

Class Identification Guidance (Informational)

We provide general, informational guidance on trademark classification to help Users understand the process. This is not professional advice and must be independently verified with the Lawyer.

Step 06

Case-Management & Status Updates

We provide basic case-management updates and reminders based on information shared by the User or the Lawyer. We do not advise on legal strategy or application outcomes.

🚫 What We Do Not Do

To avoid any misunderstanding, the Platform and the Company expressly do not:

Provide legal advice, legal opinions, or professional trademark advice

Prepare, draft, or file trademark applications (TM-A or otherwise)

Represent Users before the Trade Marks Registry, tribunals, or courts

Guarantee trademark registration, availability, or any legal outcome

Collect or process Government / Registry filing fees on behalf of any authority

Issue trademark certificates, filing receipts, or official Registry documents

Conduct trademark searches or render registrability opinions

Handle objection replies, oppositions, hearings, or renewals under the Platform Fee

All legal work is carried out by independent Lawyers. Any trademark application, legal advice, filing, objection reply, or representation before any authority is carried out solely by the independent Lawyer in his/her own professional capacity, under his/her own terms, and not on behalf of the Platform or the Company.

🔄 How the Platform Works

Our process is straightforward. Here is what happens after you submit a request:

1

Submit Your Request

Fill in the information form on the Platform with your trademark details, applicant information, and contact details. This form is an administrative tool only and is not a trademark application or a government filing of any kind.

2

Pay the Platform Fee

Pay the Platform Fee of ₹2,250 (or the amount displayed) for administrative facilitation and Lawyer coordination services. This fee is separate from the Lawyer’s professional fee and the Government/Registry filing fee, which are payable separately.

3

Confirmation Email — Commencement of Service

A confirmation email will be dispatched to your registered email address. Dispatch of this email constitutes formal commencement of our administrative facilitation services. Please check your inbox, spam, and promotions folders.

4

Lawyer Coordination

An available independent Lawyer empanelled on the Platform will initiate contact with you using your registered communication details. The Lawyer will advise you on trademark class, documents, application details, and next steps in his/her independent professional capacity.

5

Your Approval Before Filing

You are solely responsible for reviewing and approving all application details — including the trademark, applicant name, class(es), and description of goods/services — before authorising the Lawyer to file. No application is filed without your approval.

6

Filing & Acknowledgement

The independent Lawyer files the trademark application with the Trade Marks Registry in his/her professional capacity. The application number or filing acknowledgement will be shared with you once available.

Post-filing: After the application is filed, all examination, objection, publication, opposition, and registration proceedings are entirely managed by the Trade Marks Registry under the Trade Marks Act, 1999, and are beyond the Platform’s control. Objection replies, hearings, and other post-filing services are handled by the Lawyer separately and are not covered under the Platform Fee.

Independent Lawyers on the Platform

The Platform connects Users with independent Lawyers who are enrolled with a State Bar Council in India and are qualified to advise on trademark matters. These Lawyers are independent professionals and are not employees, partners, agents, or representatives of the Platform or the Company in any capacity.

The Company does not supervise, direct, or control any Lawyer’s professional conduct, legal strategy, or advice. The Company does not recommend, rank, certify, or guarantee the qualifications or outcomes of any Lawyer. Any professional relationship, including confidentiality and privilege, exists solely between the User and the Lawyer.

Important Limitations

Users must be aware of the following limitations before using the Platform:

  • The Platform does not guarantee that a Lawyer will be available at all times or that facilitation will be completed within a fixed period.
  • The Platform does not guarantee trademark registration, freedom from objection or opposition, or any legal outcome.
  • Trademark examination, objection, publication, opposition, and final disposal are controlled entirely by the Trade Marks Registry and applicable law, and are outside the Platform’s control.
  • The Platform Fee of ₹2,250 is for administrative facilitation only and is not the complete cost of trademark registration. Government fees and Lawyer fees are additional and separate.
  • The Platform does not verify whether the trademark being applied for infringes any third-party rights. Users bear sole responsibility for this.
